Justice Delayed is Justice Denied

Gareth Peirce on police terror tactics and state impunity

Gareth Peirce speaking in London on 4 February 2013

As Alfie Meadows prepares for his third trial for violent disorder at the 2010 student protests despite being nearly killed by a police baton strike, campaigning solicitor Gareth Peirce has criticised police over its history of cover-ups and immunity from prosecution after acting unlawfully during protests.

Peirce, who has acted in some of the country’s highest profile cases including the Birmingham Six, Jean Charles De Menzes, Moazzam Begg and Julian Assange, highlighted a recent UN report that described the way the British government has dealt with the right to protest as ‘shocking’.

The report described having to ask permission to demonstrate outside parliament as ‘wrong’, called for a judge-led inquiry into the embedding of undercover police officers into non-violent protest groups and warned of another Hillsborough like tragedy if the current police tactics, including kettling, continue.

Peirce said the state used demonstrations as an opportunity to assert its power and to experiment in ways to assert that power while committing crimes itself.

Instead of protesters focusing on their campaigns, they now have to fight an ongoing battle against the state to enjoy that right, she said.

At a recent meeting to commemorate Bloody Sunday speakers highlighted ‘cover-ups’ and ‘acting with impunity’ as a repetitive feature of state intervention at demonstrations, she said.

She said: “If the state comes in to assert its power, to crush the protest, it can’t do it lawfully, it does it unlawfully, and it goes to extreme ends to assert its power yet it enjoys absolute immunity from the consequences.”

After hearing from a friend of Blair Peach, a miner at Orgreave, a football fan at Hillsborough, Alfie Meadows and Carole Duggan’s aunt at a meeting, organised by Defend The Right To Protest called Justice Denied, Peirce tied the cases together with the thread of state violence, cover-up and impunity.

The solicitor said in Southall, when protesters marched against fascists in 1979 the police formed themselves into an army and cavalry and rode into crowds smashing people on the head.

Blair Peach was killed by a baton strike to the head.

The police then went onto a commune and again hit everyone over the head before arresting and prosecuting them with false charges sapping the energy and resources of the community, she said.

The tactics the police learnt from Southall, she said, were put into effect at Orgreave five years later in 1984. By then the police had formed themselves into standing armies with chief constables of each county giving themselves ‘absolute exceptional powers’ over tactics.

Peirce said: “At Orgreave they lured the miners in. As one miner said ‘we were like the Belgrano waiting to be sunk’. [Then] the [police] ranks opened and in charged police horses followed by [police with] short shields. It was like a medieval army with shields and cavalry smashing the miners over the heads and then arresting them. But not being an army they have to justify [the arrests].

“It was certainly intended to smash the miners strike and in many ways it did. It sapped the strength of the union. It had to. After one day at Orgreave they had 95 of their members facing potential life imprisonment. It was intended to destroy them.

“Come the trial these officers had no idea who they had arrested. So they sat in a classroom and were told what happened that day and they wrote it all down. So when the trial came, two-by-two, officers said who they had arrested. But because on that sunny day the nation’s photographers were there every police officer was in shot. So 48 days into the trial the prosecution gives up, they don’t even get to the defence. It was a pack of lies, but what happened; immunity.

A few years later at Hillsborough, she said, the same chief constables ‘behaving like dictators’ sat down the same officers in a classroom and dictated a ‘pack of lies’ as they did at Orgreave, and that is what the Hillsborough families have exposed after so many years.

“But like Bloody Sunday shows, Southall shows, Orgreave shows and Hillsborough shows it’s state criminality for a purpose. To assert power and to use any means necessary.”

Trade Union support builds for the GDC and against political policing

Dominic O'Hara of the Glasgow Defence Campaign spoke at Dundee Trades Union Council May Day march. To applause, he pointed out that the resistance which working people and trade unionists are beginning to show to the cuts will inevitably come up very quickly against the police and other state forces. Dominic encouraged that resistance, stating that the working class will not accept being made to pay for the crisis of the ruling class' system.

At Glasgow's May Day March, hundreds heard Len McCluskey, president of the Unite union, support the Glasgow Defence Campaign and its battle against political policing. He spoke of the determination of the Scottish revolutionary John MacLean to fight for free speech and quoted the famous words of MacLean at his trial in 1918 when he was sentenced to five years penal servitude for his opposition to the imperialist war. Speaking of the thuggish behaviour of the London Metropolitan police over the last year, McCluskey sent the same message to Strathclyde police: “Keep your sleazy hands off our kids!”

Dundee Trades Union Council, which supports the GDC, had put forward the motion which was passed unanimously at the Annual Conference of the Scottish Trade Union Congress a few days ago. We include the text of this resolution below and urge all contacts to take this into their union organisations- and all other organisations, community campaigns and political groups.  We also include a model resolution for this. Please let the GDC know of progress in this. The GDC can provide a speaker for meetings and everyone is urged to take up this offer to assist in spreading the opposition to political policing and the cuts.

Dominic is himself a member of the Unite union since his battle with the fast food multinational KFC. He took a principled stance against unpaid and compulsory overtime and was illegally sacked for this action. Then, Strathclyde police were hesitant about interfering with the solidarity pickets organised by activists in the Govanhill area of Glasgow. Despite conspirational car park chats between the cops and the local KFC manager who urged them to act to clear the pickets- the local community was informed about KFC's bullying and encouraged to boycott this low pay- crap food outfit's profitable operations.

Now, as we know, Strathclyde police have stepped up their political policing campaign in the southside of Glasgow and elsewhere. GDC supporters are learning every day of the determination of the cops to stifle and stall resistance to repression and limit and control legal political expression. The GDC though is more determined and will continue to organise and gather support from all organisations and individuals.

This week GDC comrades are meeting to discuss the legal campaign against Strathclyde police's repressive actions. The GDC is not a criminal or illegal organisation. The resistance to the cuts is not a criminal campaign. The GDC is seeking the views of all supporters on calling for a legal and public inquiry into Strathclyde police and its campaign of political policing.

Last week’s STUC congress in Ayr unanimously passed the following motion from Dundee TUC, condemning the recent spate of political arrests of student activists in Glasgow, and the attacks on the right to protest more generally:

That this Congress expresses its concern at recent actions by some police forces in Scotland, which appear to be designed to intimidate anti-cuts activists, particularly young people and students, as opposed to fulfilling any legitimate law and order function. These include incidents such as those at Vodafone and the Hetherington in Glasgow.
 Congress:
1) notes the public concern expressed on these cases by, amongst others, John Pilger, Ken Loach and Peter Mullan
2) Recognises that some form of non-violent direct action is a legitimate tool of political campaigning
3) recalls its existing policy concerning local authority impositions on the routes and timings of legitimate protest marches
4) resolves, in the context of heightened and possibly long-term political opposition to government policy, to call on the General Council to raise these concerns with the Scottish Government and local authorities and to exhibit appropriate solidarity with those it considers targeted by these tactics.

Glasgow Defence Campaign
MODEL RESOLUTION.

The Glasgow Defence Campaign has been established in order to defend people's rights to free speech and political organisation. The campaign arose out of the direct experience of  Strathclyde police attempting to prevent campaigning against the cuts in Glasgow. We seek support from all organisations, groups and individuals: trade unions, community, student, civil rights, legal, religious and political.

The Glasgow Defence Campaign welcomes the support expressed in the speech made by the General Secretary of the Unite Trade Union, Len McCluskey, at this years May Day March in Glasgow. The GDC also welcomes the motion unanimously passed at the Annual Conference of the Scottish Trade Union Congress. The GDC expresses its thanks to Dundee Trade Union Council for raising the motion and welcomes the concern shown by these labour movement organisations at the recent behaviour of police across Scotland. As the motion states: this “...appears to be designed to intimidate anti- cuts activists...”. Glasgow Defence Campaign can assure its wide range of supporters, amongst which we include Dundee Trades Union Council, that intimidation may be the aim of the state authorities but they have only succeeded in making all more determined to unite to defend our rights to protest.

Can we ask all supporters of the GDC to consider raising the following model resolution through their Trade Union branches, community, student, civil rights, legal, religious and political organisations and to send on the details to us in order that we can add that support to our campaign. Thank you.

“The Glasgow Defence Campaign has been established to oppose political policing and defend democratic rights in the struggle against the cuts in Glasgow.

We condemn the recent police attacks on the right to protest experienced by anti- cuts activists across Scotland.

We condemn all the tactics employed by the police in their campaign against protest: street stops, repeated requests for personal details, door stepping visits to homes at unreasonable hours, attempted interviews with minors without parental permission or legal support, false charges and police perjury, police intimidation in court, repeated police approaches to legal protest activity.

We further condemn the restrictive bail conditions imposed on those charged which prevent knowledge of the undemocratic actions of the police from being brought fully before the public.

We support the Glasgow Defence Campaign and all other campaigns and individuals fighting to challenge unjust use of the law to intimidate protest.

We note the Glasgow Defence Campaign is seeking the views of all supporters on calling for a legal and public inquiry into Strathclyde police and its campaign of political policing.”

Support builds for Saturday's demonstration against political policing - message from John Pilger

Today, the renowned journalist and film-maker John Pilger forwarded on the following message to the Glasgow Defence Campaign:

"The police in Britain have begun a political war of intimidation against those who exercise their right to protest peacefully. No where is this more evident than in the outrageous actions of the Strathclyde police against the Glasgow Defence Campaign, including a direct attack on the right of free speech and peaceful assembly. Who will be next? If the police are allowed to succeed, other legitimate campaigns will be targeted. It's imperative the Glasgow Defence Campaign has the support of all of us."

Dr Derek Wall, former Green Party of England and Wales principal speaker, also sent the following:

"I am saddened but not surprised by the repression faced by your campaign.  Attacks on those who openly dissent are increasing and only through broad campaigns of solidarity in defence of the right to protest can public space for criticism be maintained.  In this spirit I would like to add my voice to your campaign."

The GDC thanks them for their principled messages of support, which will be read out at Saturday's protest. We call on everyone concerned with basic freedoms and democracy to send on messages of support and to stand shoulder to shoulder with those facing up to political policing and intimidation in Glasgow.

All out for Saturday! No to political policing! Defend the right to protest!

URGENT: Police arrest third person in Glasgow for 9 December protests!

The Glasgow Defence Campaign has just learned that in the last 30 minutes, a 17 year old student, already facing charges from the violent eviction of the Free Hetherington, has been arrested by police in relation to protests in Glasgow on 9 December 2010. As far as we are aware, he is being held in Baird Street police station - we call on everyone to phone up to inquire as to his safety and to demand his release. Let Strathclyde police know that an injury to one is an injury to all.

CALL BAIRD STREET POLICE STATION - 0141 532 4100 or 0141 532 4543 - AND DEMAND HIS RELEASE!

Yesterday, 11 April, another activist was outrageously found guilty on politically-motivated, stitched-up charges of police assault also in relation to the 9 December student protests, with another activist facing trial for events that day on 6 June. The GDC once more calls on people to remain vigilant at all times and above all - SAY NOTHING AND SIGN NOTHING - at least without a lawyer present. In making this arrest after four months, Strathclyde police are engaging in open intimidation and will be attempting to lean on people, create divisions and gather information.

Their dirty tricks must be exposed and opposed.

No to political policing! Defend the right to protest!

UPDATE: People will be gathering outside Baird Street police station from 2pm to demand his release - spread the word ad head down in solidarity.

GDC statement on conviction of anti-cuts activist in Glasgow - 11 April 2011

GLASGOW DEFENCE CAMPAIGN

Courts criminalise anti-cuts activist in Glasgow

Today, Monday 11 April, a young member of Fight Racism! Fight Imperialism! (FRFI) was found guilty of assaulting police officer Douglas Forrest during student protests in Glasgow on 9 December 2010. Judge Alan Finlay, sitting in Glasgow’s Justice of the Peace Court on St. Andrews Street, deferred sentencing for six months; a second charge of breach of the peace was dismissed.

Speaking outside the court, a GDC spokesperson stated:

“The Glasgow Defence Campaign is absolutely clear. Justice has not been served, and today’s events once more confirm our analysis of the political, class-ridden nature of the entire Scottish judicial system. Those in court on Thursday to witness the prosecution case saw three Strathclyde police officers – Douglas Forrest, Alan Carter, and PC Prentice – shamelessly perjure themselves in order to secure the conviction of a dedicated anti-cuts activist who participated in a student protest on which no members of the public or the police were injured and no property was damaged. This is nothing more than the political police in action.”

The only point on which the prosecution case rested was that it was inconceivable that police officers could be capable of lying under oath in court. Judge Finlay, in an irrelevant outburst against one defence witness on the legality of the initial protest, exposed the political nature of the court itself. His basis for conviction was the “credibility and reliability” of the police witnesses. Anyone familiar with the history of the British judicial system and its day to day workings cannot regard this as anything other than a sordid joke.

We are neither surprised nor shocked by today’s events. The political policing logged by the Glasgow Defence Campaign over the past twelve months clearly exposes the determination of Strathclyde police to smash any serious organisation against the cuts before it has even begun. In Glasgow, it is members and supporters of FRFI who have so far been targeted but in the coming period anyone serious about resisting the wholesale attacks on public welfare and the working class will be forced to confront the various bodies of the British state and stand up for democratic rights. The cuts to legal aid funding in Scotland, concentrated in Glasgow, represent a further attack on working class access to justice in this city. Within such a context, we would do well to remember the words of that most astute member of the British establishment, Brigadier General Frank Kitson: “Law should be used as just another weapon in the government’s arsenal, and in this case it becomes little more than a propaganda cover for the disposal of unwanted members of the public.”

Despite all this, we remain optimistic. If justice is denied to the people in the courts, we have no doubt they will find it on the streets and fight for it by any means necessary. Strathclyde police’s political harassment has completely failed to drive opposition off the streets and demoralise those committed to fighting the cuts; it has succeeded only in exposing increasing numbers of people to the true nature of the police and courts in this country.

Dominic O’Hara will again be facing trial this month on trumped up charges relating to his arrest following protests in Glasgow on 29 January. We will be organising solidarity protests outside the court and ask people to regularly check the blog for updates and to send us on any instances of political policing they have faced. A protest will be held this Saturday, 16 April, between 1-3pm outside the Royal Bank of Scotland on Gordon Street in Glasgow city centre to speak out against the cuts and in defence of the right to protest.

The Glasgow Defence Campaign would like to thank all our friends and supporters who have stood by us and attended the court sessions in solidarity in recent days. We extend our solidarity greetings to all others facing criminalisation for political activity against the cuts and offer our organisational resources to their defence. To Strathclyde police, we offer only a word of advice: oppression breeds resistance.

More police harassment in Glasgow

The GDC has today learned of further harassment endured by supporters of Fight Racism! Fight Imperialism! in Glasgow on 31 March 2011. The two were stopped in a car on George Square at 12.15pm upon leaving a demonstration outside Glasgow City Chambers in solidarity with the workers, service users and supporters of the Dalmornock Accord centre in the city’s East End. A heavy police presence was in place for those condemning the Labour city council’s appalling decision to demolish the centre in order to build an access road for the Commonwealth Games in 2014. The council is refusing to fund a replacement, citing the ‘economic climate’, while handing over millions to private developers and land speculators.

The two FRFI supporters were detained by eight officers from Strathclyde Police and questioned in the back of a police van marked SF58 KPY. Some of the officers are Crown witnesses in an ongoing criminal prosecution case against one the activists for participating on the anti cuts protests in Glasgow on 9 December 2010. The GDC regards the questions as an unlawful attempt to interfere with witnesses and a report of the incident has been lodged with our legal advisors.

We would like to take this opportunity to remind Strathclyde police that they can only demand the identity details of people suspected of committing or witnessing an alleged offence. This was a point that the officers (All A-Division) 128, 115, 192, 116, 123, 486, 472, 319 seem to be unaware of. When asked on what legal basis details were being requested against one FRFI supporter, the response was aggressive – stating that the offence was not providing details when requested. This is simply not the law. We would suggest some form of elementary police practice training for the officers involved in this latest instance. The same supporter was threatened ‘with the jail’ for an apparent breach of the peace in the back of the police van, for simply asking reasonable questions.

The GDC now regard officers from Stewart Street as out of control. The detention and questioning took place in the middle of the day in the centre of Glasgow without lawful basis. The pretence for this was to ascertain whether one of the FRFI supporters was ‘allowed to be’ in the city centre, despite the bail condition requiring him to stay out of the city centre being overturned over three months ago, and officers from Stewart Street being fully aware of this.

It is primarily officers from Stewart Street who have been involved in the ongoing harassment and political policing the GDC has logged on this page. One can only wonder about the conduct of these officers with other people, vulnerable or otherwise, and how they behave out of the public eye and behind closed doors.

The GDC is urging people to remain vigilant when attending demonstrations, and in particular leaving demonstrations, given the increased police activity described here. We remind everyone it is not a crime to oppose cuts, it’s not a crime to protest, it’s not a crime to engage in public assembly, it’s not a crime to speak out against injustice, these are our rights and they must be defended; they are under attack. It’s time resistance was built.

Protest outside Glasgow District Court on Thursday 7 April

On Thursday 7 April, a young supporter of Fight Racism! Fight Imperialism! will be facing trial on serious charges relating to his arrest during student protests in Glasgow on 9 December 2010.

The Glasgow Defence Campaign is calling on all those interested in defending the democratic right to organise against the cuts to attend the protest outside Glasgow District Court on 21 St. Andrew's Street (off Saltmarket). Friends and supporters will be gathering from 9.30am on Thursday 7 April but people should make their way down throughout the day to show solidarity.

The arrest and charges against this particular activist were clearly a case of political policing. Another FRFI supporter was arrested on 9 December, and this followed months of harassment by Strathclyde police officers of FRFI stalls in Govanhill, which led to political material being seized from the streets and charges being issued (and then dropped) relating to the selling of the newspaper of Fight Racism! Fight Imperialism! The supporter in question was again arrested following protests in Glasgow on 29 January. See the police harassment log for a full incident list.

As the Glasgow Defence Campaign has consistently pointed out, state harassment of protest and dissent is only set to increase. Three people are currently awaiting trial after being arrested in their houses and charged in relation to Strathclyde police's eviction of the Free Hetherington occupation at Glasgow University on Tuesday 22 March. Another activist from Glasgow is currently in jail after being arrested outside Topshop during protests in London on 26 March.

We are confident that such harassment and criminalisation can be successfully defeated. We are determined that the actions of Strathclyde police on behalf of their political masters can be exposed and opposed. Once again, we call for maximum unity and action in defence of democratic rights. "Don't panic, organise!"

Strathclyde police carry out another eviction in Glasgow

Less than 48 hours after a widely-condemned operation involving 100 officers violently evicting students occupying a building in Glasgow University in opposition to education cuts, Strathclyde police this morning deployed 'dozens' of police officers to evict Margaret Jaconelli from her flat in Dalmarnock in Glasgow's East End. As Jack Jaconelli told reporters today: “What’s this operation costing? There must be about a hundred and fifty police here. Terror tactics…they took the demonstrators away so that nobody could see them. An operation this size is a joke.”

Once again, the commitment of Strathclyde police and Glasgow City Council to defending the political and economic interests of the rich and the powerful at the expense of basic democratic rights and dignity has been exposed in this shameful episode.

See BBC news video here.

Below we reproduce a statement from the Glasgow Games Monitor 2014 on this morning's eviction.

Jaconelli family evited: some 'legacy'
After kicking up a huge fuss and reavealing the hypocrisy behind Glasgow City Council’s ‘Legacy’ claims for the Commonwealth Games 2014, the Jaconelli family were finally evicted today at around 7.20 am after Sheriff officers and ‘dozens’ of police arrived at 5.00 am.

The Jaconelli’s have been barricaded in their home now for nearly a week after a last-minute offer of ‘mediation’ by the Scottish Government was rejected by the City Council unless the Jaconelli’s left their home. The City Council have repeatedly said that the gap between their offer and the Jaconelli’s demands was ‘unbridgeable’, yet as we’ve repeatedly pointed out, enormous compensation fees for speculators like Charles Price have been quite happily ’bridged’ by the City Council. The double-standards are there for everyone to see.

There is much more to be said about this case (and we will say it all in time) but for now we want to congratulate the Jaconelli’s and their family, friends and supporters for fighting back against a City Council who would happily have walked all over them.

We’ve said all along that mega-events like the Commonwealth Games are more about land-grabs, than helping the local community; more about property speculation than social housing; more about the image of the city than its reality. Close observers of the Jaconelli struggle have now seen the truth of those observations. The City Council will now try to bury this story, but we have a feeling its going to run on and on…

URGENT: Police arrest more students following Glasgow University eviction

The GDC has received word that this morning, Strathclyde police officers arrested a young protester at his home in connection with the eviction carried out by police and security at the Free Hetherington at Glasgow University yesterday morning. It is likely that the police will be targeting more people throughout the day.

As they say - "Don't panic, organise!" It is crucial that the actions of the police are publicised and exposed. Phone Stewart Street police station to demand the release and ensure the safety of Aiden Turner. He was arrested at his home between 7.30 and 8am this morning and is facing serious charges. The FRFI supporters arrested on student demonstrations in December and January are facing near identical charges. Clearly a pattern is emerging. We cannot allow Strathclyde police's outrageous and politically-motivated actions to go unchallenged.

PHONE STEWART STREET POLICE STATION ON 0141 532 3000 AND DEMAND AIDEN'S RELEASE AND AN END TO TARGETED ARRESTS OF STUDENTS!

English Defence League given a free hand to attack anti-cuts activists in Newcastle

The GDC has learned of an instance of political policing of a different kind that took place in Newcastle at the weekend. Fascist thugs from the English Defence League turned up at the Monument in Newcastle city centre to disrupt stalls organised by Fight Racism! Fight Imperialism!, Tyneside Campaign against Racism!, and the Socialist Party. Anti- cuts campaigners fighting for services and jobs heard the unemployed abused as scroungers by the EDL and asylum seekers and Muslims were also racially abused and intimidated. The response of the police was to fold their arms and let all this take place without warnings or intervention. A very different approach to the way protesters against the system have been treated, in Glasgow, Newcastle  and London. This GDC site has ample evidence of this.

We know the cops are organised and paid to protect the powerful and wealthy and to disrupt, assault, intimidate and criminalise opposition. Where they can't do this, their fascist mates- the bootboys for British bankers and British imperialism- are allowed to get on with the dirty jobs while a blind eye is turned.

A new pamphlet from Fight Racism! Fight Imperialism! Looks at some of the lessons so far from the beginning of the battle against the cuts. Called “No cuts- Full stop! Capitalist crisis and the public sector debt”  available at www.revolutionarycommunist.org,  it contains a section on the specific lessons of political policing drawn from our recent experiences. Govanhill, Glasgow was the working class community where last summer comrades went out to campaign against the cuts and straight away came up against the police who were determined to limit and crush democratic rights if necessary.

The fascist EDL are no different. They want the streets free of opposition to the attack on welfare and jobs and  free of working class organisation so that their millionaire masters' budget can be pushed through. The Glasgow Defence Campaign calls for unity to defend the right to organise and protest against police and fascist threats.

NO TO POLITICAL POLICING!
NO TO THE BANKERS' BOOTBOYS!
NO TO THE EDL!

Police harassment at UNISON protest, Scottish Labour party conference, 19 March

On 19 March, UNISON held a picket of the Scottish Labour party conference outside Glasgow’s Science Centre to defend “the jobs of 34 Asylum Support Workers threatened with privatisation, wage cuts, worsening conditions and no pension guarantee. This means a worsening support service for asylum seekers with poorer qualified and paid staff, working under more stressful conditions.” Two FRFI supporters who joined the protest in solidarity were once again targeted by Strathclyde police officers.
One young activist was surrounded by officers as he stood at the side of the crowd: police questioned him as to why he had attended the protest, told that him that he should be grateful for being "allowed" to hand out leaflets and sell a political newspaper and was noted down as a "potential troublemaker" for refusing to give his details and defending his right to practice these perfectly legal activities. Up to 8 officers stood watching the two FRFI supporters as the crowd gathered round for a closing speech.
One of the FRFI supporters addressed the protesting council workers and pledged his support for their struggle against redundancies. He highlighted the importance of any action that exposes the role the Labour party is playing in implementing the cuts through councils – like Glasgow – under its control, receiving a round of applause for his intervention.
The FRFI supporters asked the union spokesman to keep an eye on any attempts by police to apprehend them as the protest dispersed. The Glasgow Defence Campaign has no doubt that had it not been for this canny intervention the police would not have hesitated to surround the supporters as they left. In the end, they were followed by two officers as they crossed a nearby bridge and finally were “allowed” to walk away without police hovering over their shoulder.
Once again, Strathclyde police have shown their commitment to harassing peaceful political activity. The GDC calls on all those interested in defending democratic rights and combating the cuts to unite in organising against Strathclyde police and Glasgow’s rotten Labour council.

Political policing steps-up in Dundee

During the week beginning 14 March, activists from the Defend Dundee Services anti- cuts group received unannounced visits from police detectives. They sought information on proposed protests justifying this on the grounds of avoiding wasting police resources in monitoring them. DC Greg Petrie was keen to ascertain in a later phone call to an activist whether there were views which regarded recent policing numbers as excessive. The detective also asked about the political organisations involved in anti- cuts protests. He left a mobile number for contact. These are concerning developments which the Glasgow Defence Campaign condemns. Such police contacts are designed to intimidate and worry activists and to suggest that there is criminal intent in open and legal political activity. We publicly reject this further extension of political policing and call for the greatest unity in organising to defend our democratic rights. We urge all those approached by the police to say nothing without a solicitor present.

Political policing challenged in Dundee

Supporters of Fight Racism! Fight Imperialism! and Socialist Workers Party members united to challenge the unnanounced presence of uniformed cops at a public meeting in Dundee. On the evening of Wednesday 16 February people had gathered at a well known venue for public meetings. They were there to hear first hand accounts of events in Egypt from some of the youth who had participated in the struggle there.

As the meeting was about to begin, two uniformed cops came into the back of the room and stood looking out over the crowd. Offering no reason for this intimidatory presence, people began to demand an explanation. They ludicrously claimed that as the event was public they were entitled to be there! The audience took a very different view and began loudly insisting that they leave. Voicing the opinion that those who objected were behaving "unreasonably" the pair slunk off.

FRFI was able to make the very real and vivid point at the meeting that our rulers here were increasingly directing the police to monitor and interfere with political organisation and activity and that vigilance and unity were necessary to defend democratic rights.

No to political policing!

GDC meeting in the Free Hetherington building

The Glasgow Defence Campaign salutes those students who occupied the old Hetherington Research Club at 13 University Gardens, Glasgow University last Tuesday. The space has been reopened as the Free Hetherington and will be used as a hub for anti-cuts organisation in the city, open to all.

The GDC is holding a meeting in the Free Hetherington building on Wednesday 9 February, 7.30 - 9.30pm and we urge everyone to come along. The meeting will discuss how we can organise against the police harassment which is intensifying as the anti-cuts struggle develops. This key political question will be introduced by an FRFI supporter and set in the context of the class nature of the state and the repressive developments in British policing over the past 30 years.

There will also be Legal Awareness training on Monday 7 February in the Free Hetherington building, between 4 and 6pm.

Anti-cuts protester in Glasgow freed on bail, 31 January

GLASGOW DEFENCE CAMPAIGN
Press release / Glasgow / 31 January 2011
Anti-cuts activist freed on bail

Dominic O’Hara, a 20-year-old student at Strathclyde University, was arrested on 29 January 2011 as he left a protest in Glasgow against education cuts and in defence of local services. Forty people picketed Baird Street police station immediately after he was detained, demanding his release. After over fifty hours in custody, Dominic was today released from Glasgow’s Justice of the Peace court on bail, with the Crown’s attempt to ban him from attending “organised demonstrations” dismissed by the judge. A legal complaint is also being pursued by his supporters after six police officers aggressively installed themselves in the court’s public seating area before Dominic went up before the judge. In a statement to the Glasgow Defence Campaign on his release, Dominic said: “I am emerging from this latest arrest more determined than ever. We refuse to let the courts and police criminalise our struggle and we stand in solidarity with all those arrested on protests across the country.” The Glasgow Defence Campaign is outraged by the police’s treatment of a young protester as a dangerous terrorist for participating in legitimate protest activity.

Dominic’s arrest was clearly an example of targeted political policing. On 9 December, he was violently arrested on student protests in Glasgow and charged with police assault and breach of the peace. On 29 January, he was the only person arrested as he was snatched off the streets by a van-load of Strathclyde police officers after leaving the demonstration. He was charged again with police assault and obstruction. Dominic is a supporter of Fight Racism! Fight Imperialism! (FRFI) and two other FRFI supporters are facing criminal trials in March relating to their political activity, including the selling of a political newspaper. GDC spokesperson Miriam Kelly stated: “These activists, along with hundreds of others in Glasgow and tens of thousands across Britain, have taken to the streets to resist the attacks on public provision by this country’s parasitic elite. We should ask: when did protest become a criminal act, to be met with violence, targeted arrest and possible jail terms?”

The Glasgow Defence Campaign is determined to organise in defence of democratic rights and against political policing. It is not only the right, but the duty, of people to take the streets against the government’s brutal cuts and we applaud the young people who have led the way in recent months. We stand in solidarity with all those attacked and arrested by the British state for their part in the protests and are determined to increase organisation and unity against police repression in Glasgow. The police’s aggressive response to recent demonstrations and direct actions is an expression not of strength but rather of profound weakness, in the face of a growing and militant movement with justice on its side. As the inspiring events in Egypt show, the tiny minority which stand in the way of the vast majority’s interests will in the end be swept aside.

The GDC is calling on individuals and organisations to send messages of support for Dominic and other activists facing trial in Glasgow to glasgowdefence@yahoo.co.uk. For further information call 07961 040 418 or see http://glasgowdefencecampaign.blogspot.com.

Anti cuts protester criminalised in Glasgow

GLASGOW DEFENCE CAMPAIGN
PRESS RELEASE
For immediate release
Anti-cuts protester criminalised in Glasgow

Dominic O’Hara, a 20-year-old student at Strathclyde University, was arrested this afternoon (29 January 2011) as he left a protest against cuts and in defence of local services. He is being held in Baird Street police station and will appear in Glasgow District Court (1 Carlton Place, next to the Sheriff Court) on Monday charged with obstruction and assaulting a police officer.

‘Dominic is being targeted for the active role he has played in fighting university tuition fees and EMA cuts’ a spokesperson for the Glasgow Defence Campaign said today. ‘The police knew he was already on bail facing two identical charges after an anti-cuts protest on 9 December and are now looking for an excuse to hold him on remand.’ The spokesperson added ‘There is now a pattern of police targeting of supporters of Fight Racism! Fight Imperialism! because of the leading role they have played in the campaign against the cuts. Supporters of the paper have been charged with selling it on the streets in a clear breach of their human rights. It also follows a period of unsuccessful police harassment of stalls supporters have held on streets in Govanhill.’

The Glasgow Defence Campaign is calling on supporters to picket the court on Monday from 10.00, and to condemn the criminalisation of those who oppose government attacks on the state sector.

Opposing the criminalisation of politics

Opposing the criminalisation of politics

The trial of the FRFI supporter facing criminalisation for selling the newspaper Fight Racism! Fight Imperialism! will go ahead on 14 March 2010 at 2pm in court number 3 of Glasgow Justice of the Peace Court. The Glasgow Defence Campaign are calling on supporters to attend the court.

The supporter, who has sold FRFI in Glasgow and elsewhere for over thirteen years stated, ‘this is a politically motivated charge being pursued by state prosecutors who appear on the face of it, willing to disregard the law they are using, and bypass the implications of human rights legislation in Scotland’.

FRFIs legal advisers are maintaining that the charge for ‘carrying out business as a street trader without having a licence in terms of Section 39 of the Civic Government Scotland Act 1982’  is not a competent charge as section 39 (3) (a) itself states ‘A street trader’s licence shall not be required for the sale of newspapers only’. Either the procurator fiscal solicitors have not read this, or, as we suspect it is a charge determined to undermine the organised resistance to the cuts.

Commenting on the implications of having to face a criminal prosecution, the supporter said, ‘We need to ask why this is happening now, for us it is quite clear, the first intention is to intimidate our members, our families and friends, they also want to warn off the growing support we have in our communities, and to prevent the distribution of our newspaper.’ Faced with the prospect of criminalisation for legitimate peaceful political activity, the Glasgow Defence Campaign have no other option other than to escalate our activity in defence of our rights to organise on the streets.  We are in talks with our legal advisers about the next step in relation to our legal defence, we reserve the right to identify and pursue those who are behind the harassment in the civil courts.

The Glasgow Defence Campaign has organised a free speech rally in the centre of Glasgow on the following date, with more to come.

Stand up for your rights! Street rally against polititcal policing.

stand_up_for_your_ rights
Glasgow Defence Campaign and Fight Racism! Fight Imperialism! supporters today (8 January) held a “Stand up for your rights” street rally in Glasgow city centre in defence of democratic rights and in opposition to political policing. On 30 December a supporter learned that he is facing criminal prosecution for selling the newspaper Fight Racism! Fight Imperialism! in Glasgow and is due to appear in court on 17 January 2011. We are clear that this citation is politically motivated and an open attempt to undermine our ability to organise against attacks on living standards in our communities. FRFI supporters have previously been charged by Strathclyde police for selling the newspaper and two are currently awaiting trial following their arrest on student demonstrations in the city last month.

The rally was a lively and militant event as over a dozen people took to the busy streets to raise awareness of growing police harassment in Glasgow and elsewhere. A large banner reading “NO to political policing!” was present throughout and an open megaphone allowed people to make their anger heard. As one young protestor made clear: “We do not have the wealth to circulate thousands of free newspapers across the country every morning but we are determined that our message is heard: we must defend our democratic rights or we risk having them taken away by the British state!” Another stated: “The establishment say that we are only out to cause trouble and destruction. Let us be clear: we are not the ones destroying already inadequate education, housing and health care; we are not the ones destroying peoples´ lives by cutting wages and benefits; we are not the ones who destroyed millions of lives in Iraq and Afghanistan! Those in power are the real troublemakers!”

In response to the intensifying state harassment, the Glasgow Defence Campaign and Glasgow FRFI have organised an open meeting on fighting the cuts and defending democratic rights. The past year in Glasgow has seen anti-fascists, Palestine solidarity campaigners, Republican activists and students all face police harassment, while in Edinburgh, three anti-cuts protestors have recently been picked up by police for participating in December´s student demos there. It is crucial that our political, organisational and legal experiences our shared for the benefit of all those active in progressive politics, and even more importantly, for those who are yet to take to the streets. All interested groups and individuals are invited to attend and speak.

Self defence is no offence!
All power to the people!
